This document serves as both our Privacy Policy and Terms of Use (collectively, the "Agreement") for our website (Autotrak.co) and mobile application (Autotrak, referred to as the "App") (together, the "Services"). Our Services allow customers to track their shipments via the website and drivers to share their location through the App to facilitate real-time tracking. By accessing or using our Services, you agree to be bound by this Agreement. If you do not agree, please do not use our Services.

1. Overview of Our Services

Our website enables customers to initiate a tracking session for their shipments. Upon starting a session, we send a text message to the assigned driver with instructions to download the App. Once downloaded, the driver can press a button to start sharing their location, which is then transmitted to the website for the customer to view in real time. The App is free to use, and we do not charge drivers or customers for this service.

2. Privacy Policy

We value your privacy and are committed to protecting the information we collect. This section explains what data we collect, how we use it, and your rights regarding that data.

2.1 Information We Collect

  • Customer Information: When a customer uses the website to track a shipment, we collect the shipment details they provide (e.g., shipment ID) and their contact information (e.g., email or phone number, if provided).
  • Driver Information: When a driver downloads and uses the App, we collect:
    • The driver's phone number (provided by the customer or entered during App setup).
    • Location data (latitude, longitude, and timestamp) when the driver enables tracking.
    • Device information (e.g., device type, operating system) for diagnostic purposes.
  • Website Usage Data: We may collect non-personal data about how users interact with our website, such as IP address, browser type, and pages visited, via cookies or similar technologies.

2.2 How We Use Your Information

  • To Provide the Service: We use customer shipment details and driver location data solely to facilitate real-time tracking of shipments. Location data is shared with the customer who initiated the tracking session via the website.
  • To Improve Our Services: Device and usage data may be used to troubleshoot issues and enhance the App and website functionality.
  • No Other Use: We do not sell, share, or use your data for any purpose beyond servicing the specific shipment tracking request. We have no plans to retain or repurpose this data in the future.

2.3 Data Sharing

  • Location data from the App is shared only with the customer tracking the shipment and only during an active tracking session.
  • We may share data with service providers (e.g., cloud hosting or SMS providers) who assist us in operating the Services, but they are bound to maintain confidentiality.
  • We may disclose data if required by law or to protect our legal rights.

2.4 Data Retention

  • Location data is retained only for the duration of the active tracking session and is deleted once the session ends (e.g., upon delivery or manual termination by the driver or customer).
  • Other data (e.g., phone numbers, shipment IDs) is retained only as long as necessary to provide the Service and is deleted within 30 days of the session's end, unless required by law.

2.5 Your Rights

  • Drivers: You can stop sharing location data at any time by pressing the "Stop Tracking" button in the App or uninstalling it. Uninstalling the App prevents further data collection.

  • You may opt out of cookies on the website by adjusting your browser settings, though this may affect functionality.

2.6 Security

We use reasonable measures (e.g., encryption, secure servers) to protect your data from unauthorized access. However, no system is completely secure, and we cannot guarantee absolute security.

3. Terms of Use

This section governs your use of our Services and outlines our responsibilities and limitations.

3.1 Eligibility

You must be at least 18 years old to use our Services. Drivers must have the authority to share their location data for shipment tracking purposes.

3.2 License to Use the Services

We grant you a limited, non-exclusive, revocable license to use the App and website solely for shipment tracking as described. You may not modify, distribute, or reverse-engineer the Services.

3.3 User Responsibilities

  • Customers: You agree to provide accurate shipment details and driver contact information. You may only use tracking data for legitimate shipment purposes.
  • Drivers: You consent to sharing your location data with the customer during an active tracking session by clicking "Start Tracking." You are responsible for ensuring your device is charged and has network coverage to enable tracking.
  • You agree not to misuse the Services (e.g., interfere with functionality, upload malicious content).

3.4 Service Limitations

  • Tracking accuracy depends on factors like GPS availability, network coverage, and device settings, which we do not control. We do not guarantee precise or uninterrupted tracking.
  • We may suspend or terminate your access to the Services at our discretion, especially for misuse or legal compliance.

3.5 Intellectual Property

All content, code, and designs in the App and website are owned by Autotrak or our licensors. You may not use them without our permission beyond what's necessary for tracking.

3.6 Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages (e.g., lost profits, data loss) arising from your use of the Services.
  • Our total liability is limited to $100 USD.
  • The Services are provided "as is," without warranties of any kind (e.g., fitness for a particular purpose, accuracy).

3.7 Indemnification

You agree to indemnify and hold Autotrak, its affiliates, and employees harmless from any claims, damages, or losses arising from your misuse of the Services or violation of this Agreement.

4. General Provisions

  • Changes: We may update this Agreement at any time by posting the revised version on our website. Continued use after changes constitutes acceptance.
  • Governing Law: This Agreement is governed by the laws of IL, USA, without regard to conflict of law principles. Disputes will be resolved in the State of Illinois courts.
